Please read these terms and conditions carefully before using this website.

1.0 Privacy Policy
This website is owned and operated by Charlotte Zimbehl, flat 4, 1c Hewison Street, London, E3 2HZ.

Before placing an order with Charlotte Zimbehl you must make sure to read and agree to these terms and conditions. If you are unhappy with any aspect of these, then you should contact our customer service via email at mail@charlottezimbehl.com before placing your order with us.

1.1 Buying products on our website
To order a product, you will need to register, login and follow the procedures set out in ‘Your Order’ section of the FAQS.

After placing an order with us, you will receive an e-mail from us acknowledging that we have received your order. Please note that this does not mean that your order has been accepted.

We must receive payment in whole for the goods that you order before your order can be accepted. Once payment has been received by us and availability of the product you have ordered is verified, we will send you an email confirming that your order has been accepted and has been dispatched. Our acceptance of your order brings into existence a legally binding contract between us.

1.2 Availability
All items are subject to availability. We will inform you as soon as possible, before accepting your order, if the goods you have ordered are not available.

1.3 Prices and Payment
Prices on the Charlotte Zimbehl website are given in British Pounds Sterling (£) and Euro (€).
Prices in £ and € are shown inclusive of UK sales tax (VAT) at the current rate of 20% but exclusive of delivery costs.
Please see the Shipping section in FAQS for current delivery costs and dates.

If your order is being dispatched to a destination outside the European Union (EU) then VAT will be deducted at the checkout stage and this will be shown on your invoice. If your order is being dispatched to a country which is a member state of the EU then the total price will include VAT at the current rate.

Please note Charlotte Zimbehl has no control over any customs or import duties that could be levied when the package reaches your destination country and for which you will be liable.

Please pay with PayPal when checking out. Please note that signing up for a PayPal account is now optional. You can complete your payment first and then decide whether to save your information in a PayPal account for future purchases or not.
The price of any product is the price in force at the date and time of your order. We may change the price of any product before you place an order. Before accepting your order, we will inform you if a product’s correct price is higher than that stated in your order and you may cancel the order.

1.4 Cancellation of Order
Under the Distance Selling regulations you have the legal right to cancel your order within 14 days of receipt of the goods. If you want to cancel your order, you need to notify us in writing within those 14 days and request a Returns Number (RN). Once you have notified us, any sum debited from your credit, debit card or Paypal account will be re-credited to your account as soon as possible and in any event within 30 days of your order.

1.5 Conditions for Returning Goods
All items intended for return must have a Returns Number (RN). RNs must be obtained within 14 working days of receipt of delivery. To obtain a RN number please email mail@charlottezimbehl.com. Once you have received your RN number, please ensure that you follow the instructions emailed to you.

Notification of returns received outside of the above time frames will not be accepted. For all returns, except where the item is faulty, you will be required to arrange and pay for the return of the products to us. Please be aware that international customs duties and sales taxes are not refunded for shipments outside the European Community (EC).

We will only accept returns provided that the goods in question are returned by you and received by us in the condition they were in when delivered to you. If you do not return the goods delivered to you or do not pay the costs of delivery, we shall be entitled to deduct the direct costs of recovering the goods from the amount to be re-credited to you.

You have a legal obligation to take reasonable care of the items while they are in your possession. If you fail to comply with this obligation, your entitlement to a refund may be affected. We request that you do not remove tags until you are completely satisfied that the items will not be subject to return within 14 days. We also request that items are returned with their original packaging.

This is not intended to be a full statement of your rights under the distance selling regulations. Full details of your rights under the distance selling regulations are available from you local Citizen’s Advice Bureau or your Local Authority’s Trading Standard’s Office.

1.6 Exchange
Subject to stock availability, we will exchange items that are returned to us within 14 days of being received by you. Please note we can only exchange an item for the same item in a different size.

1.7 Faulty Goods
All items returned as faulty will be inspected and any items deemed subject to wear and tear will not be accepted as faulty. We will replace a faulty item if a replacement is in stock and available. If you wish to be sent a replacement, please make your request clear when emailing to receive your Returns Number.

In case we cannot offer you a replacement, you will have the choice of receiving a credit note or a refund to the value of the item at the time of purchase and any shipping costs occurred. Please note that refunds onto credit cards can take up to 30 days and are subject to your bank’s refund regulations.

1.8 Liability
Our liability for losses you suffer as a result of us breaking this agreement is strictly limited to the purchase price of the Product you purchased and any losses which are a foreseeable consequence of us breaking the agreement. Losses are foreseeable where they could be contemplated by you and us at the time your order is accepted by us.

You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from our site. The importation or exportation of certain of our goods to you may be prohibited by certain national laws. We make no representation and accept no liability in respect of the export or import of the goods you purchase.

Nothing in these terms and conditions limits any statutory rights you might have as a consumer or our liability to you for any fraud, fraudulent misrepresentation, death or personal injury resulting from our negligence.

You confirm that all information supplied by you in using this website is true and accurate and that you have the legal authority to purchase goods or services using this website.

By accepting these terms and conditions, you authorise us to use, store or otherwise process any personal information which related to and identifies you to the extent reasonably necessary to provide the services which are available through our website.

We are committed to ensuring that your information is secure. In order to prevent unauthorised access or disclosure, we have put in place suitable physical and electronic and managerial procedures to safeguard and secure the information we collect online.

2.2 Entire Agreement
We intend to rely upon these terms and conditions and any document expressly referred to in them in relation to the subject matter of the contract between us. While we accept responsibility for statements and representations made by our duly authorised agents and we will provide you with any variations from these terms and conditions to be confirmed in writing.

2.3 Jurisdiction
This website, these terms and conditions and any contract entered into as a result of usage of this website are governed by and construed in accordance with English Law. The parties to any such contract agree to submit to the exclusive jurisdiction of the courts of England and Wales.

We do not store credit/ debit card details, nor do we share customer details with any 3rd parties.

2.8 How we use Cookies

1. Your Order
When you place an order with Charlotte Zimbehl a confirmation of your order and the amount charged to your credit, debit card or PayPal account will be sent to the email address you have registered with us. This document will contain your unique order number and details of the items you have purchased. Please keep this documentation somewhere safe in the unlikely event you have a problem.

2. Payment Methods
We accept online payment in a secure environment via PayPal (no account with PayPal necessary).

All transactions are shown in either British Pounds Sterling (£) or Euro (€) and are shown inclusive of UK Sales Tax (VAT) at the current rate which is 20% or in or Euro (€), also inclusive of 20 % VAT. This will appear on your order confirmation and is itemized for you as you pass through the checkout.

If your order is being dispatched to a destination outside the European Community (EC) this sales tax will be deducted at the checkout stage and this will be shown on your invoice. If your order is being dispatched to a country which is a member state of the EC then the total price will include VAT at the current rate.

3. Using the Website
You do not need to login or register in order to browse the Charlotte Zimbehl Website. However you cannot purchase items in the shop unless you have registered your details (your name, email address and password).

Use the links on the page to login as a returning customer, or to register for the first time. Your login details are stored securely by Charlotte Zimbehl and remain confidential. We will not sell your data to third parties or share your data with other companies.

When you are shopping with Charlotte Zimbehl online and add items to your shopping bag, they will be saved. The Shopping Bag holds products you wish to purchase while you shop, the same way you use a shopping cart in a retail store. At any time during your shopping, you can return to your Shopping Bag by clicking on the round bag icon. All or any items can be removed from your Shopping Bag at any point up until final confirmation of your order.

4. Shipping
Delivery terms and prices:
Stock permitting, all orders placed with Charlotte Zimbehl are usually dispatched to all customers within 2 working days.
Whilst we have no control over the delivery of items to you, indicative timings and prices are as follows:

Orders placed Monday to Friday will be send out within 2 business days and delivered within 3 business days.
Orders placed on Friday, Saturday or Sunday will be send out within 2 business days and delivered within 3 business days.

Charlotte Zimbehl insures each purchase during the time it is in transit until it is delivered to you. We require a signature for any goods delivered, at which point responsibility for your purchased goods passes to you. If you have specified a recipient who is not you for delivery purposes (for example as a gift) then you accept that evidence of a signature by them (or at that delivery address) is evidence of delivery and fulfilment by Charlotte Zimbehl and transfer of responsibility in the same way.

Insurance:

**For shipments outside of the EC, please note that the above shipping rates are not inclusive of any customs or import duties that could be levied when the package reaches your destination country. Therefore all charge will be the customer’s responsibility.

Due to shipping restrictions, we are not able to ship to Post Office boxes. When placing your order, you must provide us with an address where our delivery service can obtain a signature upon delivery of your shipment.

All tracked deliveries will be send using DHL. You will be sent a tracking number once the goods have been dispatched.

We are only able to ship your order to one location. During the check out process, you will be asked to select the shipping address for your order.

We realise that your order may include gifts that require shipping to several different locations. To do this you will be required to place separate orders for each address you wish to ship to.

5. Returns
You have the legal right to cancel your order within 14 days of receipt of the goods. In this case, any sum debited from your credit or debit card will be re-credited to your account as soon as possible and in any event within 30 days of your order. If you want to cancel your order, you will need to follow the procedure set out below within the 14 days.
Charlotte Zimbehl will offer you a refund provided that the products are returned complete, in perfect condition, unused, fully labelled and with the original packaging. Charlotte Zimbehl will not accept returns for any non-faulty items that have been worn and tags removed.

Please note that you have a legal obligation to take reasonable care of the items while they are in your possession. If you fail to comply with this obligation, your entitlement to a refund may be affected. We request that you do not remove tags until you are completely satisfied that the items will not be subject to return within 14 days. We also request that items are returned with their original packaging.

Upon receipt of an order, if any item has been delivered with no tags, you should notify us by email on the same day. We strongly advise all customers to check garments thoroughly upon delivery before removing any attached tags and before disposing of any original packaging.

Except where items are faulty and a replacement is not available, refunds for items may be given and only at the discretion of Charlotte Zimbehl. We offer Free returns for all customers in the UK. The Charlotte Zimbehl Team will organise the return, however, you will be required to print the label.
For all International returns, except where the item is faulty, you will be required to arrange and pay for the return of the products to us.
Returns after 14 days
Returns received outside the above time frames will not be accepted.

6. Procedure for returning goods
All items intended for return or exchange must have a Returns Number (RN). RN numbers must be obtained within 14 working days of receipt of delivery by emailing mail@charlottezimbehl.com with your order number and whether you would like an exchange or refund. Charlotte Zimbehl will them email you a RN number. Once you have received this, please take care to follow the instructions emailed to you. You cannot return goods without this number.

Please be aware that international customs duties and sales taxes are NOT refunded for shipments outside the European Community (EC). It is the customer’s responsibility to retain copies of all tracking information and to ensure that the returned goods arrive with Charlotte Zimbehl within the above stated timeframe. Please note that Charlotte Zimbehl does not accept liability for returned goods.

When returning items you are strongly recommended to obtain proof of posting or the relevant couriers airway bills and documentation. We cannot accept responsibility for parcels lost in transit and you are advised to arrange your own insurance. We will only refund or provide an exchange for the costs of postage / transport where the item returned is faulty.

When returning an order or partial order the RN number must be stated clearly on the parcel and a copy of your original sales receipt must be enclosed.

7. Exchanges
We can only exchange an item for the same item in a different size, subject to availability within 14 days of receipt of your order. If you wish to exchange something, please follow the returns procedure and state in your email that you wish to exchange the item.

Exchanged items will only be dispatched after the returned goods have been received and undergone a quality control check. In this case, any sum debited from your credit or debit card from the sale of the returned goods will be re-credited to your account as soon as possible and in any event within 30 days of your order.

To make an exchange you will be required to arrange and pay for the return of the products to us. All items for exchange must have a Returns Number (RN). RN numbers must be obtained within 14 working days of receipt of delivery by emailing mail@charlottezimbehl.com. The Charlotte Zimbehl team will then reply with a RN number. Once you have received your RN number please take care to follow the instructions emailed to you. You cannot return goods without this number.

8. Faulty Items
Faulty items will only be accepted if the goods we have delivered to you were damaged on arrival. All items returned as faulty will be inspected and any items deemed to subject to fair wear and tear will not be accepted as faulty.

All items intended for return must have a Return Number (RN). RN numbers must be obtained within 5 working days of receipt of delivery by emailing mail@charlottezimbehl.com. The Charlotte Zimbehl team will then reply with a RN number. Once you have received this, please take care to follow the instructions emailed to you. You cannot return goods without this number and we reserve the right to refuse/ return unidentified returns to the sender.

We will replace a faulty item if a replacement is in stock and available. We can only replace faulty items for the same item in the same size. If you wish to be sent a replacement, please make your request clear when emailing to request your RN Number.

In case we cannot offer you a replacement, you will have the choice of receiving a credit note or a refund to the value of the item at the time of purchase and any shipping costs occurred. Please note that refunds onto credit cards can take up to 30 days and are subject to your bank’s refund regulations.
